These Terms & Conditions explain the rules, responsibilities, rights, and expectations for anyone who uses the Site or purchases any of our products, services, templates, workshops, or programs.

Dinorah Talavera / The Market Ideas (TMI) is a marketing, branding, and digital strategy company offering:

  • Digital products (templates, scripts, PDFs, workshops)

  • Done-for-you (DFY) services (websites, funnels, automations)

  • Consulting, coaching & strategy sessions

  • Membership programs (current and future)

  • Educational content and online courses

 

The Site is hosted on Wix; payments may be processed through third-party platforms such as ThriveCart, Stripe, PayPal, and Wix Payments.

2. Use of the Site

 

You agree to use this Site for lawful purposes only and in a manner that does not:

  • infringe on the rights of others

  • disrupt or damage the Site

  • attempt to copy, steal, or reverse-engineer our materials

  • interfere with security features or platform operations

 

You must be at least 18 years old to purchase any product or service.

3. Intellectual Property Rights

 

All content on the Site — including templates, PDFs, videos, trainings, emails, copy, branding, frameworks, and structure — is the exclusive property of Dinorah Talavera / TMI.

You are granted a personal, non-exclusive, non-transferable license to use materials for your own business only.

You may NOT:

  • resell

  • share

  • distribute

  • duplicate

  • upload to shared drives

  • claim as your own

  • use to create competing products

 

Unauthorized use may result in account termination and/or legal action.

4. Digital Products (Templates, PDFs, Scripts, Workshops)

 

When purchasing a digital product, you receive instant access. As a result:

  • All digital products are final sale and non-refundable

  • Access may not be shared with others

  • Licenses are for personal or internal business use only

  • We are not responsible for software issues related to Canva, Google Workspace, Word, or other tools

 

We will always assist you with access concerns to the best of our ability.

5. Done-For-You Services (Websites, Funnels, Automations)

 

By purchasing DFY services, you agree to:

  • provide timely communication and feedback

  • supply accurate information and required materials

  • meet approval deadlines

  • participate in key decisions

  • provide access to needed tools (Wix, Canva, Meta, Google, ConvertKit, etc.)

 

We are committed to high-quality work and thoughtful strategy, but DFY results depend on:

  • your offer

  • your messaging

  • your pricing

  • your audience

  • your follow-up systems

  • your ads budget

  • your consistency and participation

Revisions & Scope

DFY projects include only the revisions specified in your proposal.
Additional revisions or scope changes may incur additional fees.

Delays

If the project is delayed due to missing information, content, feedback, or approvals, timelines will shift accordingly.

⭐ 5.1 Client-Provided Assets (Copyright, Permissions & Licensing)
​

You are fully responsible for ensuring that any materials you provide to us — including images, graphics, videos, text, copy, logos, branding elements, audio files, testimonials, documents, screenshots, and any other assets — are owned by you or properly licensed for use.

​

By supplying these materials, you confirm that:

  • you own the rights to the content OR

  • you have the legal permission or license to use the content AND

  • you authorize us to use, edit, publish, and include the content as part of the project or deliverables.

 

We are not responsible for verifying copyright ownership, licensing, or usage rights of any materials provided by you or your team.

 

If any claim, complaint, or legal issue arises regarding the content you provided:

👉 You assume full responsibility and agree to hold Dinorah Talavera / TMI harmless from any liability, damages, fees, or legal costs arising from such disputes.

​

We will not be liable for any copyright violations, trademark issues, or licensing problems related to materials you submit for use in your website, funnel, or any DFY work.

​

6. Consulting, Coaching & Strategy Services

 

Our consulting and coaching sessions offer guidance and strategic support.


However:

  • we do not guarantee specific outcomes

  • you are responsible for implementing strategies

  • missed sessions may not be refundable

  • sessions must be used within the timeframe listed in your agreement

 

All coaching/consulting purchases are final unless otherwise stated in writing.

7. Booking Services Through Wix

 

When scheduling calls or services through Wix:

  • you agree to provide accurate information

  • you agree to appear at the scheduled time

  • you agree to follow the cancellation or rescheduling rules posted at booking

 

Late arrivals or missed appointments may be forfeited.

8. Payments

 

Payments are processed securely through third-party processors such as:

  • Stripe

  • PayPal

  • ThriveCart

  • Wix Payments

 

We do not store or handle payment information directly.
Failed payments may result in suspended access until payment is completed.

9. Refund Policy

​

We take pride in the quality of our work and the value of our products and services.
However, due to the nature of digital access, customized work, and limited client capacity, all sales are generally final unless otherwise stated in writing.

Below are the full refund terms:

​

A. Digital Products (Templates, PDFs, Scripts, Workshops)

  • All digital products are non-refundable

  • This includes Tripwires, Order Bumps, Mini-Offers, and all digital downloads

  • Since access is delivered instantly, refunds cannot be issued

B. Done-For-You Services (Websites, Funnels, Automations)

  • Deposits and payments for DFY services are non-refundable once work begins

  • If you decide to cancel after work has started, no refund will be issued

  • If a project is delayed due to lack of communication or missing materials, payments remain non-refundable

  • Any exceptions may be granted solely at our discretion, and will be detailed in your service agreement

C. Consulting, Coaching & Strategy Sessions

  • All coaching, consulting, and strategy services are non-refundable

  • Missed or unused sessions are not refundable or transferable

  • Sessions must be used within the agreed timeframe

D. Memberships & Subscriptions

  • Membership fees are non-refundable

  • You may cancel at any time to prevent future charges

  • Cancellations take effect at the end of the current billing period

  • If your membership has a required term (e.g., 3 or 6 months), you are responsible for the full term unless otherwise stated

E. Exceptions

We may offer refunds or partial credits only in rare cases, such as:

  • duplicate purchases

  • accidental purchases not accessed

  • technical issues preventing access that cannot be resolved

  • projects not yet started

Exceptions are granted solely at our discretion and do not guarantee future exceptions.

F. No Guarantee of Results

Refunds will not be issued due to:

  • lack of results

  • personal circumstances

  • change of business direction

  • lack of implementation

  • insufficient participation

  • audience mismatch or offer issues

Results depend on many factors outside our control.

10. User Accounts

 

If you create an account:

  • you must keep your login secure

  • account access may not be shared

  • violation of login rules may result in termination

11. Limitation of Liability

 

To the fullest extent permitted by law:

  • we are not liable for indirect, incidental, or consequential damages

  • we are not liable for business losses, lost profits, or lost data

  • your use of the Site and services is at your own risk

  • no results or outcomes are guaranteed in any capacity

 

Nothing in these Terms restricts your rights under Florida or U.S. consumer law.

We may link to tools, platforms, or external websites.
We are not responsible for their content, policies, or practices.

We may suspend or terminate access for violations of these Terms, misuse of content, abusive behavior, unauthorized sharing, or payment issues.

Any disputes will be resolved through arbitration or small claims court unless otherwise required by law.
